Terms of Service

Welcome to Cue. These Terms of Service ("Terms") govern the relationship between Cue ("we," "us," or "our") and the individual or entity ("you," "your," or "user") accessing or using our services, website, or application (collectively, the "Service").
By using the Service, you agree to these Terms. If you do not agree, please stop using the Service immediately. This Agreement may be updated from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
1. Service Description
Cue provides a platform for healthcare providers to record movement demonstrations, build a movement library, and prescribe individualized exercise programs to patients with specific hold times, reps, and modifications. Patients access their prescribed programs through the Service. The Service is provided "as is," and its availability, features, or functionality may change at any time.
Cue is not a medical device and does not provide medical advice. The Service is a tool for healthcare providers to communicate exercise prescriptions to their patients. All clinical decisions remain the sole responsibility of the prescribing provider.
2. Eligibility
You must be at least 18 years old to create a provider account. Patient accounts may be created by individuals 13 years or older, or by a parent or guardian on behalf of a minor. By using the Service, you represent that you meet these requirements and have the authority to agree to these Terms.
3. User Accounts
Providers: Provider accounts are intended for licensed healthcare professionals and movement practitioners. You are responsible for the accuracy and appropriateness of all exercise programs you prescribe through the Service.
Patients: Patient accounts are linked to a provider via an invite code. You are responsible for following your provider's instructions and consulting your provider with any questions about your program.
4. Content Rights
Your Content
You retain ownership of the movement videos, descriptions, and other content you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to store, process, and display that content as necessary to operate the Service.
Group Practice Libraries
Content uploaded to a group practice library is accessible to all practitioners within that practice. The practice administrator controls access and membership. Content contributed by individual practitioners remains accessible to the practice if the practitioner leaves.
5. Acceptable Use
When using the Service, you agree to:
- Use the Service only for its intended clinical purpose.
- Not upload content that is unrelated to movement prescriptions or exercise demonstrations.
- Not share patient information through the Service beyond what is necessary for the prescribed program.
- Comply with all applicable laws, including healthcare regulations in your jurisdiction.
6. Privacy and Data Protection
We take the privacy of health-related information seriously. Our handling of your data is described in our Privacy Policy. By using the Service, you acknowledge that exercise program data (including movement videos, hold times, reps, and modifications) is transmitted between provider and patient accounts.
7. Payment and Subscription
The Service is currently free during early access. We may introduce paid plans in the future. If we do, we will provide advance notice, and your continued use after any pricing change constitutes acceptance of the new terms.
8. Limitation of Liability
The Service is provided "as is" without warranties of any kind. We are not responsible for clinical outcomes resulting from exercise programs prescribed through the Service. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service.
Our total liability for any claims relating to the Service is limited to the amount you paid us in the past 12 months, or $100, whichever is greater.
9. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your license to use the Service ends. Providers may export their movement library before account closure upon request.
10. Dispute Resolution
All disputes arising from these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association. These Terms are governed by the laws of the State of California.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes through the Service or by email. Continued use after updates indicates acceptance of the revised Terms.
